U.S. Entry Waivers
A U.S. entry waiver is for people who are inadmissible to the United States because of a criminal record obtained outside the U.S., or because of a violation of U.S. immigration law. It is available to Canadians.
Who needs one
- Canadians refused entry at a land border, airport preclearance or seaport because of a criminal record.
- Travellers whose record was disclosed to U.S. Customs and Border Protection and is now in the U.S. system, even if the offence is old.
- People who overstayed, worked without authorization or otherwise breached U.S. immigration rules.
- Clients who already hold a Canadian record suspension but still need to cross the border.
A Canadian pardon is not enough
Even after a record suspension is granted in Canada, the United States keeps its own copy of any record it has already collected. To cross the border lawfully you still need a U.S. waiver.

How long a waiver lasts
The U.S. government has full discretion over whether to grant a waiver and for how long. Approvals are commonly issued for one, two, three, four or five years. A waiver is temporary multiple re-entry permission — not a permanent clearance — and must be renewed before it expires to avoid a gap in your ability to travel.

RCMP certified criminal record check and, where required, local police records supporting the application.
Court dispositions
Certified copies of the charges, outcomes and sentence details for each matter on your record.
Personal statement
A written explanation of the circumstances, your rehabilitation and your reasons for entering the United States.
Supporting evidence
Employment letters, references, community involvement and any other material that supports a favourable exercise of discretion.
Form I-192 package
The application is assembled, biometrics arranged and the file submitted for adjudication by U.S. Customs and Border Protection.
